Federal authorities are challenging a law of the state of Illinois that guarantees financial assistance to immigrant studentsclaiming that in doing so are other residents as “second -class citizens.”
According to the Department of Justice, these laws unconstitutionally discriminate against US citizens, who do not receive the same reduced registration rates or scholarships, which directly contradicts federal law.
Thus, the Trump administration presented a Demand in the southern district of Illinois against the state of Illinois, Governor Pritzker, the State Attorney General and the Board of Directors of the State Universities of Illinois.
In demand, the United States seeks to prohibit the application of Illinois laws that require universities to offer state registration fees to all foreigners who maintain residence in Illinois, regardless of their legal presence in the United States.
Federal Law, argues, prohibits higher education institutions to offer foreigners benefits that are not offered to US citizensso they ensure that the laws of Illinois openly contradict the federal law and, therefore, the Supreme Clause of the United States Constitution.
“According to Federal Law, schools cannot provide undocumented immigrants benefits that do not offer US citizens,” said Attorney General Pamela Bondi.
“This Department of Justice has already submitted multiple demands to prevent US students from being treated as second -class citizens. Illinois now joins the list of states where we fight tirelessly to claim the federal law, ”he continued.
“Illinois seems to want to win the career towards the abyss as the main sanctuary state of the country. Its erroneous approach, which requires state registration, scholarships and financial aid to undocumented immigrants, clearly violates federal law,” said federal prosecutor Steven D. Weinhoeft for the southern district of Illinois.
“This policy treats undocumented immigrants better than US citizens living in other states and further encourage illegal immigration, all at the expense of the taxpayer. Illinois citizens deserve something better, ”he said.
This demand arises after two executive orders signed by President Trump that seek to ensure that undocumented immigrants do not obtain tax benefits or preferential treatment.
Before Illinois, the Department of Justice filed a lawsuit against the State of Minnesota to prevent it from continuing to offer reduced state registration to certain immigrant students.
In addition, the Administration made Texas annul its state law on registration for undocumented students just a few hours after a federal demand was filed. Subsequently, a similar action was presented in the state of Kentucky.
