The First Circuit Court of Appeals gave the order on Thursdaywhile the appeals on the legality of the section of the Tax Cuts and Budget Law of President Donald Trump that was approved by the Congress and that restricts the financing of Medicaid.
The ruling revoked the decision of a lower court and keeps the controversy driven by Trump and Republican Allies in force, which this summer prohibited the state payments of Medicaid for the organization.
The measure is part of a package of internal and fiscal policies promoted by the administration and has generated criticism from defending groups of the Reproductive rightswhich consider the suspension of funds as a direct attack on women’s health.
Federal Law has already prohibited Medicaid funds to finance abortions, but The new measure affects other planned parenthood services, including primary care.
The unanimous vote of Judges Gustavo A. Gelpí, Lara E. Montecalvo and Seth R. Afframe allows to temporarily retain federal refunds to those services, a financial setback for the organization.
Planned Parenthood filed a lawsuit claiming that the measure seemed designed to affect only the largest abortion suppliers and that could limit the provision of services. Federal judges have shown mixed decisions, which maintains in uncertainty the operation of clinics and care for hundreds of thousands of patients.
“We will continue to fight against this unconstitutional law, although this court has allowed patients to affect,” Alexis McGill Johnson, President and Executive Director of Planned Parenthood Federation of America, declared Alexis McGill Johnson, In a statement.
“Patients who depend on the essential medical care provided by the Health Centers of Planned Parenthood cannot plan their future, decide where to receive attention or control their lives, bodies and futures, all because the Trump administration and its supporters want to attack Planned Parenthood and close the health centers.”
